Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner.
Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes if fraud, technical failures, or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right to verify the identity of the winner prior to prize fulfillment.
Sponsor reserves the right to reschedule prize dates due to weather conditions, operational needs, force majeure events, or other circumstances beyond Sponsor’s control. Winner assumes all risks associated with travel to and from Camp DeForest and participation in on-site activities.
9. RELEASE & LIMITATIONS OF LIABILITY
By participating, entrants agree to release and hold harmless Sponsor, its parent companies, subsidiaries, affiliates, and their respective officers, directors, employees, and agents (collectively, the "Released Parties") from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) participation in the Sweepstakes; (b) the receipt, ownership, or use of the prize or any portion thereof; or (c) any typographical or other error in these Official Rules or any Sweepstakes-related materials.
The Released Parties are not responsible for: (1) lost, late, misdirected, damaged, or illegible entries; (2) any problems or technical malfunctions; (3) any error, omission, interruption, or delay in the operation of the Sweepstakes; or (4) any injury or damage to an entrant's or any other person's property related to or resulting from participation in the Sweepstakes.
Sponsor is not responsible for entries lost, delayed, misdirected, or damaged in the mail.
10. PUBLICITY & USE OF PERSONAL INFORMATION
Except where prohibited by law, participation in the Sweepstakes constitutes entrant's consent to Sponsor's use of entrant's name, likeness, voice, photograph, biographical information, and/or postcard submission for promotional, advertising, and publicity purposes in any and all media now known or hereafter developed, worldwide, in perpetuity, without additional compensation, notification, or permission.
Personal information collected from entrants will be used by Sponsor for administration of the Sweepstakes and in accordance with Sponsor's Privacy Policy. Information may be used to contact entrants regarding the Sweepstakes, notify winners, and for future marketing communications from Sponsor. Entrants may opt out of marketing communications at any time. Entry into the Sweepstakes is not conditioned upon consent to receive marketing communications.
Entries may be featured in Camp DeForest’s “Camp Mail Call” digital or print communications, Trail Notes, and other promotional channels.
11. DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER; GOVERNING LAW
By participating in the Sweepstakes, entrant agrees that any dispute, claim, or controversy arising out of or relating to these Official Rules, the Sweepstakes, or the prize (including without limitation claims relating to personal injury, property damage, or alleged statutory violations) shall be resolved exclusively by final and binding arbitration, rather than in court, except that Sponsor may seek injunctive or equitable relief in a court of competent jurisdiction for matters relating to intellectual property or misuse of Sponsor property. The arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single neutral arbitrator in the State of Maine, unless the parties mutually agree otherwise. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
CLASS ACTION WAIVER
Entrant agrees that any arbitration shall be conducted in an individual capacity only and not as part of any class, collective, consolidated, or representative action. Entrant expressly waives the right to participate in a class action lawsuit or class-wide arbitration against Sponsor. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this provision is void or voidable. If for any reason a claim proceeds in court rather than in arbitration, entrant and Sponsor each waive any right to a jury trial. G
GOVERNING LAW
These Official Rules and any dispute arising hereunder shall be governed by the laws of the State of Maine, without regard to conflict of law principles. If any portion of this Section is found to be unenforceable, the remaining provisions shall remain in full force and effect.
